What does Amazon actually do in Spain?

Amazon operates its EPR Pay on Behalf service here. Where you have not given Amazon a valid EPR registration number by the end of the applicable reporting cycle, it enrols you, pays the eco-contribution on your sales to the scheme, and charges both that contribution and a service fee to your seller account. Spain is one of the markets where Amazon offers this: auto-enrolment. Amazon's own seller page states that where a selling partner is found non-compliant, Amazon may need to deactivate the non-compliant listings — or comply with the regulations on that seller's behalf. Those are the two mechanisms; which one runs in a given country is what this page records.

What does the law say about the marketplace in Spain?

Under PPWR Article 45(4) an online marketplace must check that a producer selling through it is registered before allowing the sale. That duty applies in every EU Member State and it does not move the obligation off you. In Spain, where the goods come from outside the country and the producer has appointed no representative, the online marketplace stands in as the producer and carries the financial, information and organisational duties. Read that against the paragraph above: the rule is what Spain requires of a marketplace, and pay-on-behalf is what one company has decided to sell. Neither one is evidence for the other.

What does it cost, and what does it cover?

€25 per EPR category a year, from 1 January 2026 (previously €24.99 + 3%, same notice as France). Does any of this take the obligation off you?

No. Paying a fee through a marketplace does not change who counts as the producer in Spain. You do, if you ship to buyers in Spain yourself. Under PPWR Article 3(1)(15)(d) a seller established outside the European Union that supplies packaged goods to end users in a Member State under a distance contract is the producer in that Member State. Having no company in the EU is not an exemption from that; it is the condition that creates it. A Pay on Behalf charge is a payment, not a registration: it produces no registration number in your own name, and every other channel you sell through checks for a number, not for a payment. Whether registration applies to you in Spain at all, whether an authorised representative is required, and which authority runs the register are answered on the decision card for Spain.
