Is there a volume threshold in Spain?
There is a line, but it exempts nobody. A producer under 15 tonnes of packaging a year in Spain may report on a simplified basis; registration and every other producer obligation apply from the first unit. This is the distinction that catches most sellers out — a reporting concession is not an exemption.

Who counts as the producer for sales into Spain?
You do, if you ship to buyers in Spain yourself. Under PPWR Article 3(1)(15)(d) a seller established outside the European Union that supplies packaged goods to end users in a Member State under a distance contract is the producer in that Member State. Having no company in the EU is not an exemption from that; it is the condition that creates it.

Do you need an authorised representative in Spain?
A producer established in another EU Member State must appoint an authorised representative in Spain under PPWR Article 45(3). That part is settled EU law. Spain has also taken up the Member State option: a producer established outside the European Union must appoint an authorised representative established in Spain.

Does the marketplace take the obligation off you?
Under PPWR Article 45(4) an online marketplace must check that a producer selling through it is registered before allowing the sale. That duty applies in every EU Member State and it does not move the obligation off you. In Spain, where the goods come from outside the country and the producer has appointed no representative, the online marketplace stands in as the producer and carries the financial, information and organisational duties.

Whether a marketplace also pays the fee on your behalf is a commercial arrangement, not a rule. In Spain Amazon runs its EPR Pay on Behalf service and charges €25 per EPR category a year from 1 January 2026.
