Do you need an authorised representative in Austria?

A producer established in another EU Member State must appoint an authorised representative in Austria under PPWR Article 45(3). That part is settled EU law. Austria has also taken up the Member State option: a producer established outside the European Union must appoint an authorised representative established in Austria, where the goods are delivered to private end users by distance or mail order.

Does the marketplace take the obligation off you?

Under PPWR Article 45(4) an online marketplace must check that a producer selling through it is registered before allowing the sale. That duty applies in every EU Member State and it does not move the obligation off you. In Austria a distributor or platform may not place packaging from an unregistered producer on the market, and fulfilment service providers must stop serving that producer.
