Who counts as the producer for sales into Belgium?
You do, if you ship to buyers in Belgium yourself. Under PPWR Article 3(1)(15)(d) a seller established outside the European Union that supplies packaged goods to end users in a Member State under a distance contract is the producer in that Member State. Having no company in the EU is not an exemption from that; it is the condition that creates it.

Do you need an authorised representative in Belgium?
A producer established in another EU Member State must appoint an authorised representative in Belgium under PPWR Article 45(3). That part is settled EU law. Whether Belgium has taken up the Member State option for producers established outside the European Union is not published: the competent authority has issued nothing on it that we could find. That is a fact about Belgium, not a gap in our checking. We could not confirm this at an official source we could read on 2026-09-02, so treat it as an indication and not as settled. Confirm it in writing with Interregional Packaging Commission (IVCIE) before you rely on it.

Does the marketplace take the obligation off you?
Under PPWR Article 45(4) an online marketplace must check that a producer selling through it is registered before allowing the sale. That duty applies in every EU Member State and it does not move the obligation off you. Beyond that, no national rule on marketplace liability in Belgium was published at a source we could read, so we say so and do not extrapolate from what other countries do. Confirm it in writing with Interregional Packaging Commission (IVCIE) before you rely on it.

Whether a marketplace also pays the fee on your behalf is a commercial arrangement, not a rule. In Belgium Amazon runs its EPR Pay on Behalf service and charges €25 per EPR category a year from 1 January 2026.
