Who counts as the producer for sales into Poland?
You do, if you ship to buyers in Poland yourself. Under PPWR Article 3(1)(15)(d) a seller established outside the European Union that supplies packaged goods to end users in a Member State under a distance contract is the producer in that Member State. Having no company in the EU is not an exemption from that; it is the condition that creates it.

Do you need an authorised representative in Poland?
A producer established in another EU Member State must appoint an authorised representative in Poland under PPWR Article 45(3). That part is settled EU law. Poland has not been seen to take up the Member State option that would require a producer established outside the European Union to appoint one. That is an absence of evidence, not a published confirmation that none is needed. We could not confirm this at an official source we could read on 2026-09-02, so treat it as an indication and not as settled. Confirm it in writing with Ministry of Climate and Environment before you rely on it.

Does the marketplace take the obligation off you?
Under PPWR Article 45(4) an online marketplace must check that a producer selling through it is registered before allowing the sale. That duty applies in every EU Member State and it does not move the obligation off you. Beyond that, no national rule on marketplace liability in Poland was published at a source we could read, so we say so and do not extrapolate from what other countries do. Confirm it in writing with Ministry of Climate and Environment before you rely on it.

What does the fixed part cost before your first kilogram?
Registering with the authority costs PLN 200 a year — that is the official fee for the register itself, and it is separate from anything a scheme charges. For Statutory product fee (opłata produktowa) — the source this site holds Poland rates from — we found no published minimum annual or membership fee at a page we could read logged out on 2026-09-04. Not obtained means we did not find one, not that there is none. A third fixed cost is an authorised representative, where one is required.
