Germany does publish an exception that runs by packaging type rather than by volume: producers of reusable packaging served by an existing reuse system, one-way beverage packaging that carries the statutory deposit, sales packaging for hazardous filling goods and packaging shown not to be supplied to end users in the country sit outside the obligation for that packaging. It reaches only the types named and only the duties the provision itself lifts — it is not a general release from packaging EPR, and it does not remove your registration. Who counts as the producer for sales into Germany?
You do, if you ship to buyers in Germany yourself. Under PPWR Article 3(1)(15)(d) a seller established outside the European Union that supplies packaged goods to end users in a Member State under a distance contract is the producer in that Member State. Having no company in the EU is not an exemption from that; it is the condition that creates it.

Do you need an authorised representative in Germany?
A producer established in another EU Member State must appoint an authorised representative in Germany under PPWR Article 45(3). That part is settled EU law. Germany has also taken up the Member State option: a producer established outside the European Union must appoint an authorised representative established in Germany. Even with a representative, registering and filing the data report must be done by you.

Does the marketplace take the obligation off you?
Under PPWR Article 45(4) an online marketplace must check that a producer selling through it is registered before allowing the sale. That duty applies in every EU Member State and it does not move the obligation off you. In Germany a distributor or platform may not place packaging from an unregistered producer on the market, and fulfilment service providers must stop serving that producer.

Whether a marketplace also pays the fee on your behalf is a commercial arrangement, not a rule. In Germany Amazon does not offer to pay on your behalf: it checks EPR registration numbers and deactivates the listings that have none.
